Can student loans be included in bankruptcy filing or do you have to pay those back no matter what?

My husband and I both have student loans. We aren’t near bankruptcy yet, but we may be headed there soon. Would those be included or do you have to repay them no matter what? We live in California if that matters.

Bankrupcy does not generally discharge student loans.

You can not discharge federal student loans in bankruptcy.

All student loans have to be paid back under new law in 2004. You cannot default on them and you MUST pay them back at all costs, they can take your house, car, assets and sieze your bank account in order to be repaid. Best course of action, get an extension and re-finance your loans at a reputable company with lower interest rates. That’s all you can do.

In my state of Missouri, we have to repay the student loans no matter what. Check with the college/university etc. you got the student loan from about it, they should be able to tell you.

I was a student in england and I had a stuent loan and I was told that I only had to pay it back when igot a will paying job.But becouse I fell ill and must unlikely to got good job,with same help form the socials i had it wirte off.I am not saying that you sould say you are ill and unable to work. But the socials can help you got part or all of your loans wirte off.

You have to pay student loans back no matter what. They do not disappear if you file bankruptcy or go to prison or for any other reason besides death.
