American Credit Collections — How to NOT collect a debt


I got a nastygram from American Credit Collections, LLC. out of Scranton, Pennsylvania in the beginning on June, 2007. I immediately called their telephone number and received a series of harassing telephone calls. This company does not appear to be a licensed debt collector in my state, a class I felony. Additionally, their collection letter threatened post-judgment remedies, “aggressive legal action” and stated they were verifying my employment and attempting to locate assets that could satisfy the debt. Please note, this debt, if at all legitimate, is way beyond the statute of limitations. Of course, ACC has somehow managed to re-age or otherwise misrepresent the date of chargeoff. According to my records, the account was opened March 24, 1998, last payment May 10, 1999 and charged off on December 20, 1999 for $658. What follows is fantastic example of the illegal tactics that “fly by night” debt collection companies use. Be warned. Update: If you’ve paid these people by credit card or check, I’d love to find out the name on the account they routed the money through. Please shoot me a PM!

Bill collectors are maggots, roaches, pure scum. Their ranks are comprised of the lowest class of people. They’re nasty because they’re so miserable. They’re talentless and worthless and they know it. Deep down they hate themselves. Remember that you’re speaking to a miserable lowlife if you ever have to speak with one and that will be your power. This woman is an idiot. Good for you in recording her, if she has contacted you, she has satisfied minimum contacts in the particular state that you reside, so its irrespective if Penn. allows for recorded conversations. The part about their company not being registered in your state was fucking priceless, as was the part when that stupid cunt said she would do everything possible to embarrass you, nice harassment. Typical dumb fucking debt collector ignorant of consumer protection laws.

…derogatory information from your credit report. They’ll usually do that without contacting the collection agency at all. I’ve had CCJ’s (Civil Court Judgments) show up as PAID on my credit report. Remember this Maxim: All law is commerce. All commerce is contract. No contract, no controversy. No controversy, no case. It’s a beautiful thing. Don’t discuss ANYTHING over the phone with a debt collector. Request it in writing. That’s the letter you copy when you send your conditional acceptance.

I had so much fun with debt collectors once I learned how to handle them. I’ve discharged thousands. Here’s what I did: As a third party interloper with no first hand knowledge of the matter, a debt collector who purchases debt has no contract with you. It’s all about contracts. He asked for validation. Verfication of the debt is different. They have 30 days to do this. If not, oh well.

@NASTYDEBTCOLLECTORS unless they take legal action in which case it extends it to a further 12 years. Of course its the date fo the last payment not the date when you incuredd the debt that counts.

@kmbkb Exactly!!!!!!!! The debt dies with the original creditor who tries to collect and fails. They are insured for that and they should lend responsibly in the first place!
Why should those third-party leeches try and make money for themselves on the back of that?
If they choose to buy someone’s else DEAD debt that’s THEIR PROBLEM, not yours!!!!!

I don’t know how people who do this for a living sleep at night.
When you call someone especially over a third party debt you have NO IDEA what has been going on in that person’s life or why they’re behind in payments.
I couldn’t phone people up for fear they had huge medical bills after cancer or were recently widowed with 6 children.
How can people be so damned self-righteous? I guess anyone can be a bully over the phone……

Nice job. This happens all the time. I had a book company do this to be once, but I blew it off. My credit was already trashed by my ex-wife.
They think they don’t even have to tell you what the debt is for. “Your verification is that you paid the bill before.”

this is a good example of how NOT to collecto a debt, being a debt collector myself I am ashamed of the companies that conduct their business this way. The company i manage fully complies with the FDCPA and the FTC and thanks to that in all the time we have been operating we have not been sued!!!

Allied are notorious for brashness and rudeness in the UK, as a cursory glance at UK forum sites will immediately tell you.

Their UK office is in Glasgow, Scotland, and that office is staffed exclusively by contradictory, brash, ignorant, unhelpful neds (a well-known Scottish insult). I daresay that there are more lobotomy cases there than in Bedlam.
